We provide the following alternative services:

TRACK 1

SUMMARY

(This plan is unique to MedWitness, Ltd.)

Initial record review by licensed physician is $500.00. There is no further charge if the case lacks merit or if you elect not to proceed for any reason. All other services charge in the range of $1,000.00-2,000.00 for this review. Our plan is designed to keep out of pocket costs low for cases that lack merit.

If the case has merit and you elect to proceed then the cost is usually another $2,500.00 to get the expert on board with an opinion. You always get full credit for the $500.00 paid in.

This program includes the review of the records by two physicians, an expert opinion from an appropriate specialist and subsequent amendments, changes and modifications requested or ordered by Court - subject to terms.

In summary:

Review of case w/ merit and expert opinion....$3,000.00 (Two experts confer)

TRACK 2

SUMMARY

MedWitness, Ltd. simply refers to a qualified expert for a charge of $500.00.

The expert charges separately for review and report. The experts are independent contractors and the usual and customary charge for their component is about $2,000.00 (nationally), but can vary more or less. MedWitness, Ltd. has nothing to do with this billing and gets no part of it.

All fees are paid, whether merit exists or not, just like any other expert company.

In summary:

Review of case (merit or no merit)....$2,500.00 (Referral fee of $500.00 plus estimated, independent expert review fee of $2,000.00)

COMPARISON OF TRACKS 1 AND 2

With Track 1 you only pay $500.00 for a review of a case that lacks merit. You pay a total of $3,000.00 if merit exists and the case is certified by the expert. All payments go through MedWitness, Ltd. You pay about $500.00 more than under Track 2 if there is a case but you pay about $2,000.00 less if there isn’t.

Here, you pay a lot less when there is no case so that you’re out of pocket costs are limited. You pay a bit more where there is a case and where you’re likely to recover the costs anyway.

BOTH TRACKS

Our experts will testify anywhere in the U.S. but that does not mean that we can produce experts that come from anywhere in the U.S..

MedWitness, Ltd. can also assist lawyers to prepare medical questions for deposition and trial. These are designed to posture the case in your favor prior to trial.

MedWitness, Ltd. has developed a witness program to counter the enactment of CAPS on damages. Expert witnesses will tie in the concept of pain to actual physical damages, both present and future, such that it is compensable.
