We have been in business for almost 40 years and over this time have developed strong working relationships with not just medical doctors across the nation but with law firms as well. A medical case must have a strong, experienced, well financed and high quality law firm if there is to be any decent chance to win the case and obtain a respectable recovery.

It is also the case that every State in the Nation requires a medical Certificate of Merit from a qualified physician in the field at issue to review the records and facts of the case and approve it for acceptance by the court. This is to say that without such a Certificate of Merit or Affidavit of Merit a medical malpractice case cannot be filed anywhere. This Rule is strictly enforced. Every law firm filing a medical malpractice case must sign a sworn statement that they have consulted with a qualified physician who has approved the case for merit in a written document which they must also file with the court.

In essence the Certificate of Merit is what MedWitness, Ltd. does. Our company first reviews your medical records and any and all other available facts of the case. We determine whether the case has merit or not and then prepare the Certificate of Merit for the court (and/or law firm). The purpose of the law requiring this is to keep frivolous claims against doctors out of court. But it is important to note that by frivolous the law means that a medical claim can not be concluded from the Complaint. The claim has to be obviously impossible such as suing a doctor for leaving in a suture (stitch) in a surgery when the suture is supposed to be left in. This would be frivolous. But also note that frivolous doesn't mean that the claim has to be a certain amount or not. As long as it is possible that the doctor did something wrong then the suit is permitted without regard to the dollar amount claimed.
